SENATOR EMMANUEL BWACHA
*Sen. Emmanuel Bwascha CON, came under the senate standing rules of 42/52 which means personal explanation.*
_*Sen Emmanuel Bwacha CON,* Senator Representing Southern Taraba domain moved a Motion on the abuse and Gross Violation of fundamental Human Rights of 14 Members of His Constituents._
```Notes! With rude shock and concern over the continuous perpetration of human rights violation of Nigerian citizens with impunity by some institution, from both the executive and judicial arms of Government.```
Worried. That the Nigerians are yet to forget in a hurry the danger that engulfed this country by our youth originating from the police brutality popularly known as *#ENDSARS.*
_*Concerned That 14 of my senatorial District particularly Takum Local Government area, namely.*_
They where mischievously lured by his excellency *Arc Darius Dickson Ishaku* (DDI) to Jalingo on Friday 23rd April 2021, on arrival they whisked away with them by the police for an illegal detention for a bailable offence.
_It is common knowledge that the Nigerian constitution demands, in a matter of this nature, within 24 hours they should be charged to court or put for bail. Of the 1999 Nigerian constitution as amended._
*Their Lawyer have asked for their bail but the police refused.*
```Instead of the Police given them for bail they rather aggravated the situation by conspiring with the judiciary through an overzealous Acting Chief Registrar of the Taraba high court, His worship Hon. Bartholomew R. Kaigama.```
_*DDI* facilitated this judicial rascality by issuing detention warrant at the comfort of this residence to the police on the 14 members of the Constituents to be remanded in the Nigerian Correctional centre, Jalingo Prison. till date without according them their rights to fair hearing, surprisingly, from the police custody, they were moved to Prison on a bailable offence._
```Further worried.. that the 14 members of my Constituents while travelling to honour the Governor's invitation, they had an accident and sustained various degree of injuries and as we speak, they do not have access to medical attention because of the continues detention in the prison custody.```
*Alarmed. That this is the time in the Political history of our dear country Nigeria, when Nigeria look at the Judiciary as the template of justice and hope for Common man, such black market judiciary officer is found in the corridors of the judicial arm of government.*
```More worrisom Is when the broad day robbery of the provision of the criminal justice system that has taken cognizance of fundamental rights of a suspect to be presumed innocent until he is proven otherwise before a competent court of law, as encapsulated in section 36(5) of the Nigerian constitution as amended. Thus, the police are empowered by section 62 and 63 of the police Act 2020 to release my 14 member in my Constituents on bail.
It's further violates African charter on human and people's rights, thereby constituting an illegality in the whole process.
This illegal act also violates the pragmatic efforts been made by this Hallowed Chambers to decongest of Nigeria correctional services center (Prison) as well as the breach of Covid 10 protocol.```
*Accordingly resolves to:*
1. _Urge the acting inspector General of police (AIGP) and the police service commission to investigate and sanction the officer (the police commissioner of police) who was blinded by whatever influence to authorize the unlawful arrest and detention of the 14 member of my Constituents without bail._
2. _Urge the senate to direct the national judicial commission (NJC) in collaboration with the state counterparts to sanction the acting Chief Registrar of Taraba State high court, His worship, Hon Batholomew R. Kaigama, who authorised this monumental judicial abuse that is selfishly intended to drag the good image of the judiciary to the mud._
3. _Urge the senate to direct NJC to direct his worship BR Kaigama to urgently grant bail on lenient bail terms or conditions to release them on bail pending when they will be formally arraign in court by the police if truly the police has any case against them._
4. _Urge the senate to direct the NJC to further direct his worship BR Kaigama to withdraw the purported illegal remand warranty against my 14 member Constituents as it was issued in error as he neither issued any warrant of arrest against the suspects, or the suspect appeared before him._
5. _Urge the senate to direct his worship BR Kaigama to return my Constituents to the police and enable them obtain their bail since court are shut down, as the purported remand warrant was illegal and issued in error._
